1. Acceptance of Terms
By downloading, installing, accessing, or using the Kidsoz mobile application ("App") and our website ("Site"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you (referred to as "Parent," "Guardian," or "User") and Devora Tech. ("we," "us," or "our"). If you do not agree to these Terms, you must immediately cease using the App and Site and uninstall the App from your devices.
2. Parental Consent & Supervision
Kidsoz is designed specifically for children between the ages of 2 and 8. Because the App is intended for young learners, it must be set up, configured, and managed by a Parent or legal Guardian who is at least 18 years of age. By using the App, you warrant that:
- You are the parent or legal guardian of the child utilizing the App.
- You consent to your child's usage of the App under your active supervision.
- You are responsible for configuring the Parent PIN, reviewing progress analytics, and setting appropriate daily screen-time and sleep mode limits.
3. Scope of License
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, and fully revocable license to download, install, and run the App on compatible mobile devices under your direct ownership or control. This license is granted strictly for your personal, non-commercial, educational use. You agree not to:
- Modify, copy, distribute, transmit, display, perform, reproduce, publish, or license any portion of the App's source code, assets, or graphics.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Bypass or attempt to circumvent the parental gates, PIN requirements, or other security and safety mechanisms.
4. Subscriptions, Payments & Billing
While Kidsoz provides a generous free tier with access to multiple learning modules, we may offer premium features, additional educational content, and advanced analytics via optional subscription models:
- Native App Store Billing: All financial transactions, subscription purchases, renewals, and payment options are processed natively and exclusively through Apple's App Store (iOS) or Google's Play Store (Android). We do not collect, process, or store any credit card numbers or billing details on our systems.
- Automatic Renewal: Paid subscriptions automatically renew at the end of the subscription period unless you turn off auto-renew in your device's App Store account settings at least 24 hours before the current period ends.
- Cancellation & Refunds: You can manage or cancel your subscription at any time via your device settings. Refund policies are governed entirely by Apple and Google's respective App Store terms.
5. Intellectual Property Rights
All materials and assets incorporated inside Kidsoz—including but not limited to the proprietary mascot character "Devi," 3D claymation graphics, original illustrations, audio voiceovers, musical melodies, interactive game engines, interface layouts, and software source code—are the exclusive intellectual property of Devora Tech. and are protected by international copyright, trademark, and intellectual property laws. Your use of the App grants you no ownership rights over any of these creative assets.
6. Safe Usage Guidelines & Disclaimers
Kidsoz is an educational companion tool designed to assist in early learning milestones. It does not replace real-world parenting, schooling, or professional speech and cognitive therapy. We advise parents to limit screen time in accordance with pediatric recommendations and utilize the built-in screen-time locks and sleep mode triggers.
7. Disclaimer of Warranties
THE APP AND SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE COMPLETELY ERROR-FREE, OFFLINE FUNCTIONALITY WILL NEVER BE INTERRUPTED, OR ALL EDUCATIONAL MILESTONES WILL BE SATISFIED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVORA TECH., ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, DEVICE DAMAGE, OR INTERRUPTION OF LEARNING SCHEDULES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Termination
These Terms remain effective until terminated by either party. You may terminate these Terms at any time by uninstalling the App and deleting all local data from your device. We reserve the right to suspend or terminate your access to the App or Site immediately if we believe you are in breach of these Terms or utilizing the app for unauthorized commercial purposes.
10. Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of the jurisdiction in which Devora Tech. is registered, without giving effect to any principles of conflicts of law.
